WHAT DAMAGES CAN BE RECOVERED AFTER A PHARMACY ERROR?

When a pharmacy makes an error, the consequences can be serious and long-lasting. Depending on the type of error and the individual circumstances, the injured party may be able to recover damages for the losses caused by the pharmacy error. It is important to understand the potential damages that may be available to the injured party in the event of a pharmacy error.

The most common type of damage that can be recovered after a pharmacy error is medical expenses. These expenses may include the cost of medical treatments, medications, and other related costs. This type of damage can include both the costs of treatments related to the error as well as the cost of treatments to address any long-term effects of the error.

In addition to medical expenses, the injured party may also be able to recover compensation for pain and suffering. This type of damage is intended to compensate the injured party for the physical and emotional distress caused by the error. The amount of compensation for pain and suffering can vary depending on the severity of the injury and the individual circumstances.

The injured party may also be able to recover lost wages. This type of damage is intended to compensate the injured party for any wages lost due to missed work or reduced earning capacity as a result of the error. The amount of lost wages that can be recovered can vary depending on the individual circumstances.

Finally, the injured party may also be able to recover punitive damages. This type of damage is intended to punish the pharmacy for its negligence and deter similar behavior in the future. The amount of punitive damages that can be recovered can vary depending on the individual circumstances.

It is important to remember that the legal process of suing a pharmacy for negligence can be complex and time-consuming. In order to ensure that your rights are protected, it is important to consult with an experienced attorney who can help you understand the applicable laws and ensure that your case is handled properly.
